Interest on overdue payments to/from group companies are under constant scanner of tax authorities, and possess inherent transfer pricing risks for a taxpayer. In addition, the same are also controlled by Regulators, through different ceilings provided on interest rates, depending on the nature of transaction. Therefore, an alignment in strategy from transfer pricing and a Regulatory perspective is required to be put in place, to avoid any unintended repercussions for the organization.
